PLANNING BOARD MINUTES
July 23, 2007
7:00 PM



The Planning Board for the City of Marlborough met on Monday, July 23, 2007 in Memorial Hall, 3rd floor, City Hall, Marlborough, MA 01752.  Members present: Barbara Fenby, Chairperson, Steve Kerrigan, Clerk, Robert Hanson, Clyde Johnson and Sean Fay. Also present: City Engineer Tom Cullen.

Meeting Minutes July 9, 2007

On a motion by Mr. Hanson, seconded by Mr. Johnson it was duly voted:

To accept and file the meeting minutes of July 9, 2007

CHAIR’S BUSINESS

City Council- New Sign Ordinance

Mr. Hodge sent correspondence of changes he thought that should be made to the new ordinance. The Board will review these comments before the next meeting on August 6, 2007.

Ms. Fenby stated that the committee has been meeting every Tuesday night with the City Council Urban Affairs Committee and going over the ordinance. The City Council is hoping for a public hearing on September 10, 2007 and to have the ordinance in place by this October.

Mr. Johnson expressed his concern of the negative feedback he has received from the community and stated that the business community feels that they are losing some of their freedoms. Ms. Fenby stated that ones right to advertise their name, not their business.

The Planning Board will meet again on August 6, 2007 for their final review before sending their comments to the City Council.

Tree Removal
Scenic Roads 7:30 pm


The Planning Board of the City of Marlborough along with the City Tree Warden held a joint public hearing on Monday, July 23, 2007 at 7:30 p.m for the removal of deteriorated shade trees located within city limits.  Members present: Chairperson Barbara L. Fenby, Clerk Steve Kerrigan, Clyde Johnson, Robert Hanson and Sean Fay.  Also present: City Engineer Tom Cullen.

Clerk Kerrigan read advertisement into record.

PUBLIC HEARING NOTICE

Notice is hereby given that the Planning Board of the City of Marlborough will hold a public hearing on Monday, July 23, 2007 at 7:30 P.M., at Memorial Hall, City Hall, 140 Main Street, Marlborough, MA in accordance with the requirements of the Code of the City of Marlborough, “Scenic Roads Act”, and MGL Chapter 40, section 15C and Chapter 87, Sec 3,4,5 of the General Laws in respect of removal of 3 shade trees and replaced with 6 roadside trees located within the limits of the public way located at 128 Farm Road.

Chris White, the City of Marlborough’s Tree Warden, presented pictures to the board the three trees that were to removed and planted at different locations along Farm Road. He stated that when the road was repaired several years ago the landscapers planted 6 maple trees at 128 Farm Road and the trees were placed where to close together. At this point in growth, the trees, are overcrowding and will not be able to grow. On his recommendation he is asking the Planning Board to consider removing three trees and replanting at other locations on Farm Road which will be replanted in the fall.

Mr. Leoleis is in favor of removing the trees. They have become too crowded and although it was nice of them to shade the property...The trees will effect his stone wall if all six trees remain as is.

The public hearing closed at 7:45 pm.

On a motion by Mr. Kerrigan, seconded by Mr. Johnson it was duly voted:

To GRANT the approval to remove the three trees and to replant those three trees at different locations on Farm Road.

SUBDIVISION PROGRESS REPORTS

Update from City Engineer

Mr. Cullen presented to the board an update of the subdivision status report of all the active subdivisions.

PENDING SUBDIVISION PLANS: Updates and Discussions

Mauro Farm

Mr. and Mrs. O’Malley of 30 Sherwood Drive North sent correspondence to the Board regarding the definivitve plans for the Mauro Farm subdivision. They are concerned about the open space, buffers, traffic and the removal of trees.

On a motion by Mr. Kerrigan, seconded by Mr. Hanson it was duly voted:

To accept and file correspondence.
